Dog Owner Liability in Florida

Owners of dogs are liable for any damage done by their dogs to a person or to any other animal. Florida law makes the owner of a dog liable for damage done by his or her dog, regardless of the owner's knowledge, or lack of knowledge, of its vicious propensities. So, the old adage that ‘every dog gets one bite’ is not true in Florida. In other words, it is not necessary to prove that the dog owner had reason to know of his or her dog's vicious propensity.

Florida Statute 767.01 provides that a dog owner is liable for damages to persons, domestic animals, or livestock. However, if the person bitten contributed to causing the incident giving rise to the dog bite, the amount of damages recoverable may be reduced by the victim's negligence.
