Dissolution of Marriage

Parenting Plans

A parenting plan is necessary in every dissolution or paternity case. The plan deals with time sharing, child support and how major decisions are made in the lives of the children.

Paternity

Unmarried parents have the same legal obligations to their children as married parents, except that the actual paternity of the children will have to be established before a court will decide issues of time sharing and support.

Custody and Visitation

Time sharing with the children of a marriage or a paternity case involves the determination by the Court or the agreement of the parents as to which parent the children mainly spend time and the specifics of when and how the children will be with the other parent.

Child Support

Children are entitled to financial support from both parents. Child Support Guidelines calculate the amount of support to be paid by one parent to the other based upon the net incomes of the parents and who is paying for healthcare and daycare.

Time Sharing

Historically, rights regarding children in divorce and paternity cases involved the concept of custody and visitation. Today, there is no award of 'custody' as such, but there must be a plan for time sharing which spells out which parent the children are with at any given time.

Alimony

A stepparent may adopt his or her spouse's child with the current spouse's consent and the consent of the other birth parent. If the child to be adopted is 12 years of age or older, his or her consent must also be obtained. In addition, a relative may adopt a minor child if the necessary consents of the birth parents are obtained.

Modification

After a final judgment of divorce or paternity is entered, things may change so that time sharing or child support payments need to be adjusted. There must be a 'material change in circumstances' before a judge can make the adjustments.

Contempt

If a party willfully fails to do something ordered by the Court that party may be brought back before the Court on a motion to hold him or her in contempt of Court. Contempt may involve failure to pay money or to cooperate in time sharing, or other matters ordered by the Court.

Adoption
