Misdemeanor - What is a Misdemeanor Crime?
A misdemeanor is any criminal offense that is punishable by a term of imprisonment in a county correctional facility, except an extended term, not in excess of one year. A misdemeanor does not include conviction for any noncriminal traffic violation or any municipal or county ordinance.Misdemeanors are classified, for the purpose of sentence and for any other purpose specifically provided by statute, as misdemeanors of the first degree and of the second degree. A misdemeanor is of the particular degree designated by statute, and any crime designated a misdemeanor without specification of degree is of the second degree.
Non-Criminal Violations
A noncriminal violation is any offense punishable by no other penalty than a fine, forfeiture, or other civil penalty. Violations of municipal or county ordinances, although punishable by incarceration, are not crimes. A noncriminal violation does not constitute a crime, and conviction for such a violation does not give rise to any legal disability based on a criminal offense.More Questions?
